These Terms are an agreement between you and Atlas 10 LLC, a Delaware limited liability company with its principal place of business at 3022 Roy Orr Blvd, Grand Prairie, TX 75050, United States (“Atlas 10”, “we”, “us”).
By creating an account or using the Service (web at
contractors.atlas10.com or our iOS/Android apps), you agree to these Terms.
If you use the Service on behalf of a business, you represent you are authorized to bind
that business.
You must be 18+ and able to form a binding contract.
Atlas 10 provides a contractor proposal and jobsite-management platform. We may modify or discontinue features. The Service is provided as a subscription/online service; availability is not guaranteed to be uninterrupted.
You are responsible for safeguarding your credentials and for activity under your account. Authentication is provided via Firebase.
You will not (a) upload unlawful, infringing, or malicious content; (b) access data you are not authorized to; (c) reverse engineer, overload, or disrupt the Service; or (d) use it to violate any third party’s rights.
You retain ownership of the content you create or upload (proposals, photos, jobsite data, imported records). You grant us a limited license to host, process, and display it solely to provide the Service.
When you upload information about your own clients or customers — including data imported from HubSpot — you are the controller and Atlas 10 is your processor. You represent and warrant that you have a lawful basis and all necessary consents to provide that data, and you will indemnify Atlas 10 against claims arising from your failure to do so. Our processing is described in the Privacy Policy; a DPA is available on request.
The Service integrates with HubSpot and Mapbox. Your use of those integrations is also subject to those providers’ terms, and we are not responsible for third-party services.
Access to the Service is arranged directly with Atlas 10 under a separate written agreement or order form. There is no in-app purchase, subscription, or billing: nothing is charged through the app, the App Store, or Google Play. Where such an agreement sets out fees, payment terms, or a term of service, those terms govern and are not modified by these Terms.
The Service, software, and branding are owned by Atlas 10. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, TO THE EXTENT PERMITTED BY LAW.
TO THE EXTENT PERMITTED BY LAW, ATLAS 10 WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES; OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM (OR USD $100 IF THE SERVICE IS FREE).
You will indemnify Atlas 10 against claims arising from your content, your use of the Service, or your breach of these Terms.
Either party may terminate at any time. You may delete your account from within the app at any time, which ends your access immediately — see Privacy Policy for exactly what is deleted, what your organization retains, and how to request an export.
These Terms are between you and Atlas 10, not Apple. Apple has no obligation to provide support or maintenance for the app. To the extent these Terms provide less than Apple’s standard Licensed Application End User License Agreement, Apple’s minimum terms apply. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent you are not located in a U.S.-embargoed country or on a prohibited-parties list.
These Terms and any dispute arising out of them or the Service are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and Atlas 10 agree that the state and federal courts located in the State of Delaware have exclusive jurisdiction over any such dispute, and each party consents to personal jurisdiction and venue in those courts.
We may update these Terms; continued use after changes constitutes acceptance.
